This activity is punishable by up to 15 years in prison.
The second type of Naples sexual abuse charge—lewd and lascivious molestation—involves touching the breasts, genital area, or buttocks of a person less than 16 years old, whether covered or not, or asking or forcing a person under 16 to so touch the defendant. If the offender is 18 or older, and the victim is less that 12, the sentence can be up to life in prison.
The third type of sexual abuse law in Naples--lewd and lascivious conduct—involves either touching a person under 16 years old in a lewd and lascivious manner, or asking a person under 16 to commit a lewd act. This does not require that the person under 16 actually commit the act. Asking alone is enough to violate the statute.
